General Provisions
These Terms & Conditions ("Terms") govern your use of itsaverydawn.com and your purchase, booking, or participation in services provided by Avery Dawn Smith, doing business as Avery Dawn ("Avery Dawn," "I," "me," or "my").
By using this website, purchasing or booking a service, or otherwise engaging with Avery Dawn, you agree to these Terms.
1. Services & Scope of Practice
Avery Dawn offers breathwork, somatic practices, group experiences, one-on-one sessions, educational content, events, and related wellness services. Specific services, formats, prices, locations, durations, and availability may change over time.
Avery Dawn provides wellness and educational services. These services are not medical care, psychotherapy, mental health treatment, diagnosis, or a substitute for professional healthcare. I do not diagnose, treat, cure, or prevent medical or mental health conditions.
You are responsible for determining whether participation is appropriate for you and for consulting a qualified healthcare professional when appropriate.
2. Breathwork & Somatic Practices
Breathwork and somatic practices may produce physical, physiological, or emotional responses. Depending on the practice, these may include changes in breathing patterns, tingling, lightheadedness, dizziness, emotional release, changes in bodily sensation, or other temporary experiences.
Participation is voluntary. You are responsible for listening to your body and communicating your needs. You may slow down, modify, pause, or stop a practice at any time.
Certain practices may not be appropriate for everyone. You agree to provide accurate and relevant information requested through participation screening or intake processes and to seek appropriate medical clearance when needed.
Participation in certain services may require completion of a separate health screening, informed consent, waiver, or participation agreement.
3. Participant Responsibility
By choosing to participate, you acknowledge that breathwork, somatic practices, movement, meditation, sound experiences, and related wellness activities are voluntary.
You are responsible for your own participation, physical limits, choices, and wellbeing during a session. If you experience significant discomfort or believe a practice is inappropriate for you, you should stop participating and seek appropriate assistance when necessary.
Every person's experience is different. Testimonials, descriptions of experiences, and information provided by Avery Dawn are illustrative and do not guarantee any particular physical, emotional, personal, professional, or other outcome.
4. Booking, Payment, Cancellations & Refunds
Prices are displayed at the time of booking or communicated before a service is purchased. Unless otherwise stated, payment may be required at the time of booking.
Payments may be processed through third-party payment providers, including Stripe.
Cancellations made at least seven (7) days before the scheduled service are eligible for a full refund.
Cancellations made less than seven (7) days before the scheduled service are non-refundable. Failure to attend a scheduled service without cancellation is also non-refundable.
Rescheduling is subject to availability and is not guaranteed.
If Avery Dawn cancels a paid service, you will be offered an appropriate refund or, where applicable, the opportunity to transfer your payment to another available date or service.
Exceptions to this policy may be made at Avery Dawn's discretion unless otherwise required by law.
5. Email & SMS Communications
If you opt in to receive marketing communications from Avery Dawn, you may receive information about classes, services, events, resources, promotions, and related updates.
You may unsubscribe from marketing emails at any time using the unsubscribe link provided in those communications.
If you expressly opt in to SMS marketing, you consent to receive recurring marketing and promotional text messages at the phone number you provide. Consent to marketing text messages is not a condition of purchasing goods or services. Message frequency may vary, and message and data rates may apply.
You may opt out of marketing text messages at any time by replying STOP. You may reply HELP for assistance or contact [email protected].
Mobile carriers are not responsible for delayed or undelivered messages. SMS and email communications are also subject to the Avery Dawn Privacy Policy.
6. Website Use & Intellectual Property
Unless otherwise stated, written materials, exercises, recordings, graphics, branding, website content, educational materials, and other original content provided by Avery Dawn are owned by or licensed to Avery Dawn and are protected by applicable intellectual property laws.
Materials provided to you are for your personal, non-commercial use unless otherwise stated. You may not reproduce, distribute, sell, publish, teach, modify, or commercially exploit Avery Dawn materials without prior written permission.
You also agree not to misuse this website, interfere with its operation, attempt unauthorized access, introduce malicious software, impersonate another person, or use the website or its content for unlawful purposes.
7. Third-Party Services
Avery Dawn may use third-party platforms for payment processing, appointment scheduling, forms, electronic signatures, communications, video conferencing, website functionality, analytics, or other business services.
These third parties operate according to their own terms and policies. Avery Dawn is not responsible for the availability, security, policies, or independent actions of third-party services.
8. Liability & Legal Terms
To the fullest extent permitted by applicable law, Avery Dawn and Avery Dawn Smith will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this website, reliance on website content, or participation in services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Avery Dawn and Avery Dawn Smith from claims, liabilities, damages, or expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights.
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
9. Changes & Contact
I may update these Terms periodically to reflect changes to my services, business practices, or applicable requirements. Updated Terms will be posted on this website with a revised effective date.
